You own a home, have a spouse and children, and want a clear plan for your belongings — a Will plan is a good starting point. If you have significant assets and want to avoid probate, consider the Trust plan. Read the description of each before choosing.

    Create an account and answer the guided questions

    Name your executor and any guardians

If you have minor children, you will also name a guardian who would care for them. Talk to these people before naming them so they are not caught off guard by the responsibility.

    Review and download your completed documents

    Sign your documents properly with witnesses

Trust & Will provides state-specific instructions telling you exactly how many witnesses you need, whether a notary is required, and what order signatures should go in. Most states require two adult witnesses who are not beneficiaries in the will. Sign in front of your witnesses on the same day. Store the signed originals somewhere safe, such as a fireproof box or with your attorney.
